Im looking for a new fantasy gaming hobby,don't want to invest in Warhammer 40k what should I play?
A tabletop RPG something like Warhammer fantasy or D&D any suggestions?
This is a rather strange question as you've effectively asked "I'm looking to buy some oranges: which are better, apples or pears?"
Dungeons & Dragons (D&D) is a roleplaying game, also known as a PnP (pencil and paper) game that involves a Game Master and generally between 2 and 5 players who each take on a single character and play out an imaginary drama in a fantasy world.
Warhammer Fantasy Battles (WFB) is a tabletop strategy battle game that involves collecting, assembling and painting an army of miniature soldiers and playing games against (typically) a single opponent to a tactical outcome.
Warhammer 40,000 (WH40k) is a science fiction strategy battle game and isn't, therefore a fantasy game at all.
I'm going to go out on a limb and assume that you are looking for a PnP RPG (as opposed to an online RPG like World of Warcraft or Warhammer: Age of Reckoning) and don't want Dark Heresy (the Warhammer 40,000 RPG).
There is a huge range of RPGs out there to explore and without a better idea of what sort of thing your circle (if you have one) likes or what sort of game you want to play, I can't really give a sensible single recommendation. However, I can heartily recommend Fantasy Flight Games as an outstanding manufacturer of RPGs, responsible for five current products, all of which are superbly supported with lots of free online material and active player communities.

If, on the other hand, you're looking for a tabletop wargame and want something economical that isn't a Games Workshop product, then you could do far worse than to look into Rackham's AT-43, which is an expandable board game that starts with a simple and engaging boxed set containing two sides of pre-painted models.
Generally, I tend to dismiss pre-painted games (being a dedicated hobbyist), but AT-43's quality is superior to other pre-paints like WizKids' "Clix" series. Plus, the miniatures are of a high standard and the game is excellent:
